This bill, amending the California Private Postsecondary Education Act of 2009, aims to provide exemptions for certain nonprofit private postsecondary educational institutions that take over existing campuses in Alameda County facing imminent closure. The Bureau for Private Postsecondary Education (BPPE), which oversees these institutions, would be required to grant an exemption to a qualifying out-of-state nonprofit institution if it has a regional accreditation, is headquartered outside California, assumes control of an Alameda County campus that is imminently closing (meaning the current operator has given notice of closure within 24 months or shows significant financial distress), possesses an endowment of at least $1 billion, and commits to continuing operations without significant interruption. These exemptions are limited to a total of six per year and apply only to the specific campus, cannot be transferred, and do not set a precedent for other institutions. Additionally, the bill authorizes the BPPE to create regulations requiring private postsecondary institutions in Alameda County to give at least 24 months' advance written notice to the BPPE before ceasing operations, unless extraordinary circumstances make earlier closure unavoidable. The Legislature has declared that these provisions are necessary due to the unique challenges of university campus closures in Alameda County.
