This bill amends existing California law regarding child custody and visitation to prohibit a person from being granted custody or visitation with a child if there is clear and convincing evidence that the person engaged in nonconsensual sexual conduct and the child was conceived as a result of that conduct, replacing a previous prohibition that specifically applied to convictions for rape where the child was conceived as a result of that violation. The bill also makes other technical changes to the Family Code, including clarifying that a person convicted of murder in the first degree where the victim was the other parent of the child may still be granted custody or visitation if the court finds no risk to the child's health, safety, and welfare and states its reasons in writing, considering factors like the child's wishes or evidence of abuse by the deceased parent.
