This bill modifies California's Housing Element Law, which requires cities and counties to plan for housing needs, by providing more flexibility in how local governments can zone land to meet their housing goals, particularly for lower-income households. It clarifies that zoning classifications like "affordable housing overlay zones," "mixed-use zones," or "combining districts" can satisfy requirements for allowing multifamily residential use with specific density and development standards, and requires a written explanation of the incentives offered by these zones. The bill also retroactively applies these changes to the sixth housing element revision cycle, starting January 1, 2019, and adjusts the definition of "substantial compliance" for housing elements, allowing them to remain in substantial compliance for a limited time even if a court later finds them out of compliance, provided the Department of Housing and Community Development is working towards a new compliant element or a court order is in place.
