This bill exempts "advanced nuclear reactors," defined as nuclear fission or fusion energy systems with enhanced safety features, reduced waste, and improved fuel use compared to older "generation II" reactors, and which have a design license approved by the Nuclear Regulatory Commission (NRC) on or after January 1, 2005, from existing California laws that prohibit the certification of new nuclear fission thermal powerplants unless specific conditions are met regarding the availability of technology for reprocessing fuel rods and disposing of high-level nuclear waste. The existing laws, which require the State Energy Resources Conservation and Development Commission (Energy Commission) to find that demonstrated technologies for fuel rod reprocessing and high-level nuclear waste disposal exist and have been approved by the U.S. government, and involve a legislative review process, will no longer apply to these advanced reactors.
