This bill makes nonsubstantive changes to existing law regarding public works projects, which are construction or repair projects funded by government entities. Specifically, it amends Section 6109 of the Public Contract Code to clarify that public entities *shall not* permit a contractor or subcontractor who is ineligible to bid or work on a public works project, as defined by Sections 1777.1 or 1777.7 of the Labor Code, to participate in such projects. The bill also reinforces that any contract entered into with an ineligible subcontractor is void, and that such subcontractors cannot receive public funds for their work, with any payments made needing to be returned to the awarding body, and the contractor remaining responsible for wages owed to workers of an ineligible subcontractor.
