This bill, by adding Section 2654 to the Penal Code, aims to strengthen protections for incarcerated individuals by prohibiting supervisors, administrators, or employees of the Department of Corrections and Rehabilitation (CDCR) from knowingly interfering with or refusing to implement prescribed healthcare that is deemed medically necessary by a licensed provider. This prohibition applies if such interference or refusal leads to substantial emotional distress or serious bodily injury, which is defined as a significant impairment of physical condition, including but not limited to loss of consciousness, concussion, bone fracture, prolonged loss or impairment of bodily function, extensive wounds, or serious disfigurement. This measure builds upon existing law that already prevents the CDCR from neglecting the health of prisoners or canceling necessary medical treatment under certain circumstances, further clarifying and expanding the accountability of CDCR personnel in ensuring proper healthcare for those in their custody.
