This bill modifies existing California law regarding unsafe product disposal and penalties. It redefines "manufacturer" to include those who own or license the brand under which a product is sold, and expands the list of entities that must accept unsafe products for return or disposal at no cost, now including recycling centers, municipal facilities, permitted solid waste facilities, household hazardous waste collection facilities, and thrift retail stores, in addition to end consumers and retailers. Importantly, the bill significantly increases penalties for violations, allowing the Department of Resources Recycling and Recovery (CalRecycle) to impose administrative penalties of $2,500 per day, or $5,000 per day for intentional violations, replacing the previous civil penalty of up to $1,000 per occurrence. These penalties will be deposited into a new "Product Recall Penalty Account" for CalRecycle's use, and CalRecycle can refer hazardous waste cases to the Department of Toxic Substances Control, which will have its own "Hazardous Product Recall Penalty Account" for related expenditures.
