This bill, amending the Local Agency Public Construction Act, significantly increases the threshold for municipal water districts and sanitation districts to award contracts for public works projects to the lowest responsible bidder. Previously, this requirement applied to contracts of $35,000 or more, but this bill raises that amount to $220,000. Furthermore, starting January 1, 2028, the Controller will be responsible for annually adjusting this dollar amount to account for changes in construction costs, as measured by the Engineering News-Record Construction Cost Index, and will publish the updated figure online. The bill also clarifies and reorganizes existing provisions regarding the bidding process, including the rejection of bids, handling of identical low bids, and the ability to perform work by day labor under specific circumstances, as well as provisions for emergency expenditures without competitive bidding.
