This bill modifies West Virginia law regarding the reassignment of school personnel, specifically teachers and service personnel, allowing for transfers to different schools or grade levels/programs within a school under certain circumstances, even after the usual deadline of the second school month, provided the reassignment is due to unforeseen shifts in student enrollment that leave staff without instructional duties. Importantly, the bill prohibits any such transfer from being based on arbitrary, capricious, or retaliatory reasons, and grants any teacher who believes their transfer violated these provisions the right to file a grievance through the established West Virginia Public Employees Grievance Procedure. The bill also clarifies that when reassignments are necessary due to surplus personnel resulting from enrollment changes, the least senior certified or licensed professional employees, or the least senior service employees of the same classification, will be reassigned, and their annual contract terms, compensation, or benefits will not be altered by the reassignment.
