This bill allows retail liquor licensees to wholesale certain "Ready To Drink Low-Proof Distilled Alcohol Products," defined as pre-mixed alcoholic beverages (excluding wine and beer) derived from distillation, containing between 0.05% and 15.5% alcohol by volume, and packaged in containers of 16 fluid ounces or less, to Class A and Class B retailers, which are types of retailers regulated by West Virginia law. The bill establishes that these products, due to their lower alcohol content and packaging, are suitable for wider distribution. Retail liquor licensees acting as wholesalers for these products will be subject to a maximum wholesale markup of 22% and will need to obtain an annual license for this privilege, costing $250. Additionally, retail liquor licensees can opt to provide delivery services for these products to Class A and Class B retailers if the order consists of 25 or more cases, for which another $250 annual license fee will apply. The West Virginia Alcohol Beverage Control Commissioner is authorized to create rules to implement these provisions.
