This bill proposes a constitutional amendment to change the process for removing certain judges and a Louisiana Supreme Court justice from office. Currently, the governor has the power to remove appointed officials, but this amendment would require the governor to certify the removal of elected or temporarily appointed judges (including district, juvenile, family, parish, municipal, and court of appeal judges) and Louisiana Supreme Court justices if they are found to have committed malfeasance (wrongdoing), gross misconduct, or incompetence while in office. This certification would only occur after a joint legislative address, where the cause for removal is formally stated and served to the judge, followed by a trial in the Senate where the judge can defend themselves, and then a vote by both the House of Representatives (requiring a majority vote) and the Senate (requiring a two-thirds majority vote) to remove the judge. If removed, the judge would be permanently barred from seeking any judicial office in Louisiana, though this process would not prevent removal through impeachment or by the Supreme Court. The amendment will be put to a vote of the people in an upcoming election.
