This bill, titled the "Respect for Local Communities Act," mandates that the Department of Homeland Security (DHS) must follow specific procedures before constructing, acquiring, renovating, or operating any new facility intended to temporarily hold individuals pending immigration removal processes, referred to as a "new processing site or detention center." These procedures include publishing a public notice in the Federal Register that allows for at least 30 days of public comment, detailing the project's scope, the agency's due diligence in adhering to immigration detention standards and environmental regulations, and including an economic impact analysis and engineering review covering waste, water, and electricity. Following the comment period, the head of the relevant federal agency must consider and respond to significant public comments, enter into a signed written agreement with the mayor or county executive and a majority of the legislative body of the local jurisdiction where the facility will be located, as well as the Governor of the state, authorizing the activity, and finally, provide Congress with a report including a copy of this agreement at least 30 days before proceeding.
