AN ACT To enact Chapter 20-B of Title 51 of the Louisiana Revised Statutes of 1950, comprised of R.S. 51:1771 through 1778, relative to artificial intelligence; to provide for legislative intent; to provide for definitions; to provide for penalties; to provide for duties; to provide for disclosures; to provide for enforcement; to provide for rulemaking; to provide for damages; to provide for an effective date; and to provide for related matters.

It also defines an "artificial intelligence companion" as a chatbot designed to simulate interpersonal, emotional, or therapeutic interaction. Businesses that own or operate these AI chatbots ("covered entities") are required to implement "reasonable age-verification measures" and "reasonable age-verification processes" to ensure users are adults, with self-attestation or just entering a birth date not being sufficient. These entities must also limit data collection, protect age-verification data, and prevent minors from accessing AI companions. Furthermore, chatbots must clearly disclose at the start of interactions and every thirty minutes that they are AI systems, not human, and do not claim to be licensed professionals or provide professional advice like medical, legal, or psychological guidance. Violators face criminal penalties of up to one year in jail and a $100,000 fine, as well as civil penalties of up to $100,000 per violation. The Attorney General's office is empowered to investigate, seek injunctions, and enforce these provisions. Individuals harmed by violations can seek exemplary damages and attorney fees.
