This bill requires law enforcement agencies in Kentucky to transmit information about seized or recovered firearms and spent shell casings to national law enforcement databases. Specifically, when a firearm is found to be unlawfully possessed, used for illegal purposes, recovered from a crime scene, believed to be connected to a crime, or is abandoned, law enforcement must send details about it to the U.S. Alcohol, Tobacco, Firearms and Explosives (ATF) eTrace system and the National Crime Information Center (NCIC). Additionally, these firearms must be test-fired, and the results submitted to the National Integrated Ballistic Information Network (NIBIN) to see if they are linked to any crimes or individuals. Similarly, any spent shell casings recovered at a crime scene, or believed to be related to a crime or illegal firearm discharge, must also have their ballistics information sent to NIBIN. Local agencies will need to create policies, approved by the Justice and Public Safety Cabinet, for handling and processing this firearm-related evidence.
