This bill amends Georgia law concerning child custody in divorce proceedings by establishing a presumption of joint physical custody between both parents. This means that unless there is a history of family violence or it's otherwise impractical for the parents to share physical custody, courts will generally assume that joint physical custody is in the child's best interest. The bill clarifies that this presumption applies until a judge holds a temporary or permanent hearing, at which point the judge can still grant sole custody, joint custody, joint legal custody, or joint physical custody as they deem appropriate for the child.
