This bill authorizes the Commonwealth of Massachusetts, through its Division of Capital Asset Management and Maintenance (DCAMM), to grant permanent easements, which are legal rights to use specific land for a particular purpose, over certain parcels of land in Milton to the Massachusetts Department of Transportation (MassDOT) for highway purposes, overriding existing laws that govern the transfer of state-owned land. As a condition for these land transfers, MassDOT must compensate the Department of Conservation and Recreation (DCR) with an amount at least 110% of the land's fair market value or value in use, determined by an independent appraisal. The DCR will then use these funds within three years to acquire comparable land for conservation and recreation, with the Secretary of Energy and Environmental Affairs determining the suitability of the replacement land. The DCAMM commissioner must submit the appraisal and a report to the Inspector General for review, and both the appraisal and the Inspector General's findings will be provided to legislative committees before the land transfer can be finalized. MassDOT will be responsible for all associated costs, including surveys and legal preparations for the transfer.
