This bill modifies how public employee unions, also known as labor organizations, represent their members and non-members in Kentucky. It establishes that while unions must generally represent all employees in a bargaining unit during collective bargaining negotiations and in enforcing agreements, they are not required to provide individualized representation for non-dues-paying members in matters like grievances, disciplinary actions, or investigations. However, if a dispute involves interpreting or enforcing a collective bargaining agreement, the union has the choice to represent a non-member, and if they do, they can charge a reasonable fee for the service. If the union chooses not to represent a non-member in such a case, or in any other proceeding not related to contract interpretation or enforcement, the non-member can hire their own legal counsel or representative, subject to employer rules. The bill also allows for written agreements between unions and non-members for specific representation services, and these changes will apply to agreements made or renewed after the bill becomes law.
