This bill, known as the Agentic Artificial Intelligence Regulatory Review Act, mandates that state agencies, which are departments or entities within the executive branch authorized to create regulations, must use advanced artificial intelligence (AI) systems capable of autonomous analysis and recommendation generation to review their rules and guidance documents. Rules are defined as regulations or requirements with the force of law, while guidance documents offer direction without legal authority. This review, which must begin by April 1, 2027, and then occur quarterly, will use AI to assess if rules are discretionary or statutorily mandated, if they conflict with or duplicate other laws, how they compare to neighboring states' and federal standards, if they are written in plain language (clear and easy to understand), and to identify all associated costs of compliance, including training, fees, administrative burdens, and the number of people affected, with the AI performing a cost-benefit analysis to determine economic impact and potential savings from modifications. Crucially, all AI analyses must be reviewed and approved by agency staff with subject matter expertise, legal experience, and authority to make final decisions, ensuring that no rule is changed solely based on AI without human oversight and verification of factual accuracy and alignment with legislative intent. Agencies are required to eliminate conflicting or duplicative rules, correct plain language issues, update outdated or burdensome regulations, and fix incorrect citations, documenting public benefits if they choose to retain a rule identified as burdensome. Finally, agencies must publish an annual report detailing the number of documents reviewed, modified, or eliminated, a summary of AI recommendations accepted or rejected, and an estimate of cost savings to regulated entities.
