AI Summary
This bill establishes new criminal offenses and penalties related to digital fraud and deceptive media, particularly concerning elections and child exploitation. It creates the crime of "fraudulent election interference" for using "materially deceptive media" (AI-generated or manipulated audio/video/images that appear real and depict actions that didn't occur) within 90 days of an election to influence its outcome, with penalties ranging from misdemeanor to felony depending on the offense. The Attorney General will have concurrent jurisdiction over these election interference cases, and the State Election Board will be required to publish findings of investigations into such offenses. The bill also mandates disclaimers on campaign advertisements that use "AI generated media," defining specific requirements for how these disclosures must be presented visually or audibly, with fines for violations. Furthermore, it prohibits the distribution of computer-generated obscene material depicting a child, defining "obscene" and "sexually explicit conduct" and establishing felony penalties, including probation conditions. A new offense of "digital identity fraud" is created, making it a felony to impersonate someone on social media platforms without authorization with intent to deceive or cause harm. Finally, the bill provides for enhanced sentencing for certain crimes when artificial intelligence (AI) is used in their commission, requiring judges to impose additional confinement and fines for both misdemeanors and felonies.
