AI Summary

This bill enacts a new law, R.S. 29:43, to protect military bases by restricting ownership of land near them by foreign adversaries or their agents, defining these terms broadly to include individuals or entities controlled by or acting on behalf of foreign governments or persons deemed a threat to U.S. national security. The law allows the Military Department of Louisiana to expropriate (take ownership of) any land within fifty miles of a military base that is owned or controlled by a foreign adversary or their agent, if this ownership is determined to pose a threat to public health and safety. The expropriation process will follow existing state laws for taking private property for public use, but will require specific statements detailing compliance with the new law and the nature of the threat being addressed. The bill also clarifies that these property acquisitions are subject to other relevant state provisions and defines "foreign adversary" based on U.S. Commerce Department determinations and "agent of a foreign adversary" to encompass a wide range of controlled individuals and entities, including those headquartered in or controlled by a foreign adversary's government, or owned by citizens of a foreign adversary who are not legal permanent residents of the U.S.
