This bill amends Pennsylvania law regarding the unlawful dissemination of intimate images, expanding the definition of what constitutes an intimate image to include depictions of partially uncovered genitals, pubic areas, nipples, or areolas, as well as the display of semen or vaginal secretions, or sexually explicit conduct. It also clarifies that the dissemination of multiple intimate images of the same individual in a single act counts as one offense. The bill introduces new provisions that elevate the offense to a first-degree misdemeanor if the dissemination is done with the intent to harass, alarm, cause physical, mental, economic, or reputational harm, to obtain profit, or for sexual arousal, gratification, humiliation, or degradation, regardless of whether the depicted person is a minor or adult. Furthermore, it defines "artificially generated intimate image" to encompass images that appear real but are not, or are created using technical means like artificial intelligence (AI) or photo editing software, and establishes a five-year statute of limitations for prosecution, or three years from the date the victim discovers the offense, whichever is later.
