This bill proposes to amend the Louisiana Constitution by adding a new section, Article I, Section 28, to establish and protect fundamental parental rights. It declares that a parent's freedom in nurturing, educating, caring for, and controlling their child is a fundamental right that cannot be infringed upon. Furthermore, any attempt to restrict these parental rights would be subject to "strict scrutiny," a high legal standard requiring the government to demonstrate a compelling interest and that the restriction is narrowly tailored to achieve that interest, unless a higher level of judicial protection is already recognized. This proposed amendment will be presented to Louisiana voters for approval or rejection in the statewide election scheduled for November 3, 2026.
