AI Summary
This bill, known as the Agentic Artificial Intelligence Regulatory Review Act, requires state agencies to use advanced artificial intelligence (AI) systems capable of autonomous analysis and recommendation generation to review their rules and guidance documents. A "rule" is defined as any regulation or requirement with the force of law, while a "guidance document" provides direction but does not have the force of law. Agencies must complete an initial AI-assisted review of all their rules and guidance documents by April 1, 2027, and then conduct these reviews quarterly thereafter. The AI will analyze whether rules are mandated by law, if they conflict with or duplicate other legal provisions, how they compare to neighboring states' and federal standards, if they are written in "plain language" (meaning clear and concise writing), and any associated costs of compliance, including training, fees, administrative burdens, and the number of affected individuals, ultimately performing a cost-benefit analysis to identify potential savings from modifications. Crucially, all AI analyses must be reviewed and approved by agency staff with subject matter expertise, legal experience, and the authority to make final decisions, ensuring that no rule is amended or repealed solely based on AI findings without human oversight. Agencies will also be required to eliminate conflicting or duplicative rules, correct language not in plain language, update outdated or burdensome regulations, and fix incorrect citations. If an agency decides to retain a rule identified by AI as unnecessarily burdensome, staff must document the public benefits and why less burdensome alternatives are insufficient. Finally, agencies must publish an annual report detailing the number of rules reviewed, modified, or eliminated, a summary of AI recommendations accepted or rejected, and an estimate of cost savings to regulated parties, making this report available on their websites.
