This bill, titled the "data center regulation act," establishes a moratorium on the approval and operation of new data centers, which are defined as facilities designed for storing and processing data. From the bill's effective date until April 1, 2027, local governments, such as counties, townships, cities, and villages, are prohibited from issuing any site plans, permits, or other authorizations for data centers. Similarly, the Department of Environment, Great Lakes, and Energy (EGLE) is also barred from granting any licenses or permits for data centers during this period. Furthermore, no person or entity is allowed to begin operating a data center before April 1, 2027. Violating this operational prohibition can result in a civil fine of up to $1,000 per day, with enforcement actions to be brought by county prosecutors or the Attorney General, and any collected fines will go to the state's general fund. This act will only take effect if a related bill, either Senate Bill No. ____ or House Bill No. 5596, is also enacted into law.
