This bill amends existing Louisiana law concerning hearings conducted by the commissioner of the Office of Alcohol and Tobacco Control (ATC), which is part of the Department of Revenue. Previously, notices had to be delivered in person or sent by certified mail within a window of ten to thirty days from the notice date. This bill expands the acceptable methods of notification to include transmission by electronic means, such as email, to an address designated by the permittee, and clarifies that such electronic service is considered complete upon transmission unless the transmission fails. The bill also removes the upper limit of thirty days for the notice period, meaning hearings can now be scheduled with less than thirty days' notice, as long as it's at least ten days from the date of the notice. These changes apply to situations where the commissioner is considering refusing an application, suspending or revoking a permit, or assessing a penalty.
