This bill, effective August 1, 2026, expands the authority of the Office of Group Benefits (OGB) to offer comprehensive weight management services. It amends existing law to allow the OGB to include weight management plans within its qualified cafeteria plan, which is a type of employee benefit plan that allows employees to choose from a menu of benefits. The bill also enacts new provisions requiring the OGB to offer enrollment in a comprehensive weight management plan to plan participants and their dependents starting January 1, 2027, which will include FDA-approved medications, metabolic health therapies, medical evaluations, prescribing oversight, follow-up care, support services, and outcome measurements. Importantly, any enrollee or dependent participating in these weight management plans, or who directly purchases weight loss medications from pharmaceutical manufacturers, will be responsible for paying 100% of the premium or cost for these specific services and medications. The OGB must also notify enrollees by October 1, 2026, about options for directly purchasing FDA-approved weight loss medications from manufacturers. This legislation does not require existing health benefit plans administered by the OGB to change their medical necessity standards, utilization management protocols, or formulary requirements.
