This bill amends Title 29 of the Pennsylvania Consolidated Statutes to establish rules for federal immigration enforcement within state facilities, which are defined as buildings or structures owned, leased, or occupied by state agencies, political subdivisions (like counties or municipalities), or certain public authorities. Specifically, it prohibits civil immigration arrests within these state facilities or within 1,000 feet of them unless the arresting authority presents a valid judicial warrant or judicial order authorizing the arrest and detention of the individual, with an exception for arrests directly related to ongoing judicial or administrative proceedings within the facility. Furthermore, individuals subjected to a civil immigration arrest in violation of these provisions can file a civil lawsuit against any state entity or its personnel that knowingly or recklessly allowed the violation, seeking damages, attorney fees, and other relief, and this right of action is not barred by existing immunity laws for state or local government parties, with a two-year statute of limitations for such actions.
