This bill modifies Kentucky law regarding grandparent visitation rights by establishing a higher standard of proof for grandparents seeking visitation when a parent is fit and capable of making decisions for the child, requiring them to demonstrate by "clear and convincing evidence" that there are compelling factors to overcome the presumption that a fit parent acts in the child's best interest and that visitation is in the child's best interest. It also removes a previous "rebuttable presumption" that visitation was in the child's best interest if the grandparent had a significant and viable relationship with the child, and instead provides a list of factors a court may consider when determining the child's best interests, such as the stability of the relationship, the potential benefits and detriments of visitation, and the wishes of the child. Additionally, the bill updates a related statute concerning temporary custody of children to align with these changes in grandparent visitation standards.
