This bill amends existing law to exempt certain land divisions from standard subdivision requirements, provided the division isn't intended to evade these rules and meets specific criteria. Specifically, divisions of land outside of existing platted subdivisions made for a single gift or sale to an immediate family member are exempt if the recipient is a child, stepchild, spouse, sibling, grandchild, grandparent, or parent of the landowner, and the land is intended for their housing, business, or agricultural needs. The land must have been owned by the grantor or a trust they control for a minimum of five years before the division for land titled before July 1, 2026, or ten years for land titled on or after that date. The parcel created must remain titled in the immediate family member's name for at least five years (or one year if created before July 1, 2026), unless it's an involuntary transfer like foreclosure or death. Furthermore, any parcel created under this exemption that is smaller than five acres cannot be further divided without obtaining a subdivision permit. The bill also includes provisions for business entities where at least 80% of ownership is held by related individuals, allowing sales or gifts to immediate family members of shareholders who have held at least 5% of shares for five continuous years. The bill declares an emergency and sets an effective date of July 1, 2026.
