Bill Summary

AN ACT to amend the insurance law, in relation to the use of telematics systems by insurers

AI Summary

This bill requires automobile insurers and third-party developers or vendors of telematics systems to make certain disclosures and adhere to specific regulations when using telematics data to determine insurance rates or discounts. Telematics systems are defined as technology that monitors, stores, and transmits information about a vehicle's location, driver behavior, and performance. The bill mandates that these entities must explain to the state's superintendent of insurance how the factors used in their telematics models or algorithms are connected to risk, demonstrate that these factors are related to the risk of loss, and publicly disclose their scoring methodologies. Furthermore, they must report on testing conducted to ensure the systems do not unfairly discriminate against protected classes or disproportionately impact them, and they must allow consumers to access their collected telematics data in a readable format. The bill also prohibits the use of telematics data for purposes other than underwriting and rating decisions and explicitly forbids unfair discrimination based on protected characteristics, including race, religion, sex, and sexual orientation, and the use of external consumer data in ways that lead to such discrimination. The superintendent is empowered to create rules and regulations to effectively administer these provisions.
