Bill Summary

A bill to amend 1929 PA 16, entitled"An act to regulate the business of carrying or transporting, buying, selling, or dealing in crude oil or petroleum or its products, or certain substances consisting primarily of carbon dioxide through pipe lines; to authorize the use of public highways and the condemnation of private property; to regulate the purchase and storage of crude oil or petroleum or certain substances consisting primarily of carbon dioxide; to provide for the control and regulation of all corporations, associations, and persons engaged in such business, by the Michigan public service commission; to define the powers and duties of the commission in relation thereto; and to prescribe penalties,"by amending the title and sections 1, 3, and 11 (MCL 483.1, 483.3, and 483.11), the title and sections 1 and 3 as amended by 2014 PA 85, and by adding sections 13 and 15.

AI Summary

This bill amends existing Michigan law to regulate pipelines carrying crude oil, petroleum, or carbon dioxide substances, with a significant change being the exclusion of carbon capture projects and carbon dioxide sequestration projects from certain regulations, provided they meet specific definitions. The bill requires the Michigan Public Service Commission (MPSC) to approve the construction and operation of all pipelines, including those for carbon dioxide, and mandates extensive applications detailing project purpose, market conditions, alternatives, environmental impacts, safety plans, and financial assurances. For carbon dioxide pipelines specifically, the bill requires detailed risk assessments and contingency plans, and it establishes specific setback distances from residential, commercial, and sensitive areas, as well as from state parks and natural areas. Additionally, operators of carbon dioxide pipelines will be subject to an annual fee based on pipeline length, with funds directed to a carbon dioxide sequestration fund.
