This bill establishes the Idaho Education Whistleblower Protection Act, which aims to safeguard individuals who report misconduct within educational settings. It defines an "educational entity" as any public or private K-12 institution receiving public funds, and a "whistleblower" as any employee or applicant who in good faith reports or assists in reporting sexual misconduct or violations of laws, rules, policies, or professional standards related to student safety. "Protected activity" includes reporting such misconduct, cooperating with investigations, or refusing to conceal it. The bill explicitly prohibits "retaliation," defined as any negative employment action taken against a whistleblower because of their protected activity, such as termination, demotion, or harassment. Importantly, any adverse employment action taken within six weeks of protected activity is presumed to be retaliation unless proven otherwise. Whistleblowers who experience retaliation can file a civil lawsuit and may be awarded monetary damages and attorney's fees, with the act taking effect on July 1, 2026.
