This bill, effective January 1, 2027, mandates that the Commissioner of Social Services provide Medicaid coverage for fertility care, consistent with federal law, which includes defining "fertility diagnostic care" as services to understand an individual's fertility, "infertility" based on various medical and reproductive factors, "intrauterine insemination" as a procedure to place sperm in the uterus, "in-vitro fertilization" or IVF as fertilization in a lab, and "standard fertility preservation services" for individuals facing medical treatments that could impact their fertility. The coverage will extend to fertility diagnostic care, standard fertility preservation services including gamete storage until age thirty or five years, whichever is later, and treatment for infertility, such as ovulation-enhancing medications for at least three cycles and at least six cycles of intrauterine insemination. Importantly, the bill prohibits waiting periods, exclusions based on prior diagnoses, disabilities, or treatments, limitations based on donor gamete use, and discriminatory limitations based on age, ancestry, color, disability, ethnicity, gender identity, genetic information, marital status, national origin, race, religion, sex, or sexual orientation. The Commissioner is also required to consult with federal agencies regarding IVF coverage and report to the General Assembly by July 1, 2027, on potential methods and funding for covering IVF under Medicaid.
