This bill amends Title 19 of the Delaware Code concerning workplace safety programs by changing the formula used to calculate safety credits for qualified employers. Specifically, it increases the potential safety credit from 20% to 40% of the calculated amount, which is determined by a formula involving the employer's "credibility" (C). Credibility is based on the employer's past safety record according to a uniform experience rating plan; if an employer doesn't have a prior rating, the Insurance Commissioner will set the credibility amount through regulations. The bill also clarifies that the "C" value is set "at such" amount, rather than "atsuch," and that safety credit packages will be rounded to the nearest whole percent. These changes will take effect for safety credit calculations communicated by the Department of Insurance on or after December 1, 2026.
