This bill establishes a Title IX Coordinator within the Delaware Department of Education to ensure compliance with Title IX of the Education Amendments of 1972, a federal law prohibiting sex-based discrimination in educational programs receiving federal funding, specifically focusing on interscholastic athletics in Delaware's public schools for grades 6 through 12. The Coordinator will provide statewide support, guidance, and oversight, including annual training for school personnel on Title IX's application to athletics, offering technical assistance and model policies to schools, collecting and analyzing data to assess compliance, and acting as a liaison with federal agencies. Schools are required to publicly report data on athletic participation and expenditures by sex, and the Coordinator can issue guidance or require improvement plans for schools with compliance concerns, while preserving individuals' rights to file grievances or federal complaints. The Department of Education, in conjunction with the Delaware Interscholastic Athletic Association (DIAA), will create rules for implementation and enforcement, and the Department will seek adequate funding for the Coordinator position and necessary data system upgrades.
