This bill amends the Law Enforcement Officers’ Due Process, Accountability, and Transparency Act by changing how legal fees are handled when a hearing committee is appointed to review a complaint against a law enforcement officer. Previously, the chairperson could appoint legal counsel for the committee upon application from a majority of the committee members, and the law enforcement agency and the accused officer would split the legal fees 50/50, though the chairperson could adjust this. Now, legal counsel can be appointed to assist the hearing committee only if both the law enforcement agency and the accused officer jointly apply in writing, and in such cases, they will each be responsible for fifty percent (50%) of the legal fees unless they agree to a different arrangement. This change takes effect immediately upon passage of the bill.
