This bill clarifies the Commissioner of Corrections' responsibilities regarding substance abuse care by ensuring that all substance use disorder treatment programs operated by the commissioner for individuals in their custody, or for juveniles in state-operated juvenile correctional facilities, meet the same standards as community-based treatment programs, unless alternative equivalent standards are agreed upon by the Commissioners of Corrections and Human Services. Additionally, the bill expands access to mental health unit beds within correctional facilities for incarcerated individuals who are mentally ill, allowing for their assessment, evaluation, stabilization, and treatment, and clarifying the procedures for transferring individuals to these units, including those who refuse voluntary treatment or require long-term care, and outlining the process for discharge and transfer upon sentence expiration if continued hospitalization for mental illness is deemed necessary.
