This bill establishes provisions for the restoration of lost parenting time in Idaho. If a parent's custody is restricted, suspended, or supervised due to an allegation of abuse that the court later finds to be unsubstantiated or insufficient, the court must order the parent to regain the lost parenting time. This restoration should happen promptly and be designed to minimize disruption to the child, ensuring comparable time for missed holidays or school breaks. Willful interference with such a restoration order can lead to consequences like contempt of court and compensatory parenting time, and violations related to custody interference may be referred to prosecutors. A "restoration plan" is defined as a written schedule outlining how a parent will regain their lawful parenting time. The bill also specifies that if a parent knowingly denies court-ordered custody or parenting time without a valid legal reason, the court will award compensatory parenting time equal to the time denied, unless it poses a risk of substantial harm to the child. This act will take effect on January 1, 2027.
