This bill enhances restrictions on automated license plate reader (ALPR) data, which are systems that use cameras and software to read license plates and compare them to databases. It centralizes all ALPR data collected by law enforcement agencies in the Bureau of Criminal Apprehension (BCA), requiring the BCA to store this data on servers within the state and to allow law enforcement agencies access to it. The bill also shortens the retention period for ALPR data that is not related to an active criminal investigation from 60 days to 48 hours, and prohibits sharing or disseminating this data outside of Minnesota unless required by a court order or warrant, including with federal agencies or other states. Furthermore, it regulates the use of ALPR systems by private entities, requiring them to post clear signage indicating their use and prohibiting the sale, transfer, or sharing of collected data without individual consent, a court order, or a warrant. Law enforcement agencies will have until December 1, 2026, to transfer their existing ALPR data to the BCA, unless it is considered active or inactive criminal investigative data.
