This bill amends existing Idaho law to define what constitutes a "wastewater system" (any facility for collecting, treating, or disposing of wastewater), a "wastewater service connection" (where a customer's sewage pipe connects to the system), and a "wastewater corporation" (a person or company owning or operating a wastewater system for compensation). Importantly, a wastewater corporation serving fewer than 100 connections, or where customers pay only for standby or capacity, will be exempt from being regulated as a public utility. The bill also clarifies that a wastewater corporation will be considered a public utility if it meets these definitions and is subject to regulation by the Public Utilities Commission, which can assess reasonable fees for its oversight. The bill declares an emergency and sets an effective date of July 1, 2026.
