This bill, effective July 1, 2026, prohibits "foreign persons" – defined broadly to include individuals not U.S. citizens or legal residents, foreign corporations, foreign governments, and certain investment entities – from purchasing or acquiring a controlling interest in single-family homes in Idaho. If a foreign person acquires such a property through inheritance, debt collection, or foreclosure, they must divest it within 180 days; failure to do so will result in a judicial foreclosure ordered by the attorney general, with proceeds distributed to lienholders, the attorney general for costs, and then potentially to whistleblowers who report violations, who can receive up to 30% of the sale proceeds. The bill also makes technical corrections to existing law regarding property ownership exceptions, clarifying that these new prohibitions on foreign ownership of single-family homes are in addition to existing restrictions on foreign ownership of agricultural land, forest land, water rights, mining claims, and mineral rights, particularly from "foreign adversaries" (countries deemed a national security threat to the U.S.).
