This bill, known as the DEATH BETS Act, amends the Commodity Exchange Act to prohibit the listing of certain types of financial contracts on registered entities, which are platforms that facilitate trading. Specifically, it prevents these platforms from offering or clearing agreements, contracts, transactions, or swaps that are based on an "excluded commodity" (a term defined elsewhere in the Commodity Exchange Act, generally referring to certain agricultural or other goods not typically traded on futures markets) and that involve, relate to, or reference terrorism, assassination, war, or similar activities as determined by the Commodity Futures Trading Commission (CFTC). Furthermore, the bill prohibits contracts based on excluded commodities that involve, relate to, or reference an individual's death, or could be closely construed as correlating to an individual's death. The intent is to prevent the trading of financial instruments that exploit or capitalize on tragic events.
