This bill, titled the "Clean Water for All Life Act," proposes to amend federal law to prohibit chemical abortions unless a healthcare provider is physically present with the patient. Specifically, it would make it a crime to provide or attempt to provide an abortion using chemical abortion drugs—defined as medications like mifepristone or misoprostol, or any similar drug intended to terminate a pregnancy—without the provider first physically examining the patient, being present at the location where the abortion is occurring, and providing a "catch kit" (a container for medical waste) and a "red bag medical waste" container (a biohazardous waste container) along with instructions for the patient to return these for proper disposal. The bill defines "abortion" as an act to terminate a pregnancy with the knowledge that it will likely cause the death of the unborn child, but carves out exceptions for acts intended to save the life or preserve the health of the unborn child, to remove a dead unborn child, or to remove an ectopic pregnancy. The term "unborn child" is defined as a human organism from fertilization until live birth. This legislation would amend Chapter 74 of title 18 of the United States Code, changing the chapter's header from "PARTIAL-BIRTH ABORTIONS" to "ABORTION CRIMES" and adding a new section to criminalize chemical abortions performed without these specific in-person requirements.
