This bill establishes "medical civil rights" by defining key terms like "emergency medical condition" (a serious health issue that could jeopardize someone's health without prompt attention) and "medically unstable" (a condition that could lead to an emergency medical condition). It mandates that law enforcement officers and correctional officers must immediately request emergency medical services for any person in their custody or under their visual or audio contact if that person communicates they are experiencing an emergency medical condition or are medically unstable, or if the officer observes these conditions. However, officers are not required to request services if they reasonably determine the person is not experiencing such a condition, or if the sole cause is intoxication, or if the person has been medically cleared within the past 24 hours. The bill also requires officers to immediately allow medical personnel to begin treatment when they are present and a person is in their custody or under their control and exhibits these conditions. Finally, it mandates that the Executive Office of Public Safety and Security, in consultation with various law enforcement and emergency medical services agencies, will submit an annual report to the Attorney General detailing the delivery of emergency medical care to individuals in custody, including data on admissions, EMS activations, and care provided before deaths in custody, with a specific focus on psychiatric crises.
