This bill, known as the Warehouse Worker Protection Act, requires employers with at least 100 employees at warehouse distribution centers to provide written and verbal notice to employees about their work quotas, including specific production targets, potential negative consequences for not meeting them (called "adverse employment actions"), and any associated bonuses. Employers are prohibited from taking adverse employment actions if quotas are not properly disclosed or if they prevent employees from taking legally mandated breaks, using bathroom facilities, or ensuring workplace safety. The bill also mandates that employers maintain records of employee performance data and quota notifications for four years, and allows employees or their representatives to request this information. Furthermore, it prohibits employers from retaliating against employees for requesting this data or reporting violations, and establishes a process for employees to file complaints with the Department of Labor and Industry, which will investigate and can impose penalties of up to $10,000 per employee for violations, with collected penalties funding enforcement efforts. Employees who suffer adverse employment actions in violation of this act can also pursue legal action to recover damages and attorney fees.
