This bill aims to standardize the factors that the State Liquor Authority (SLA), the government body responsible for issuing liquor licenses, can consider when deciding whether to grant a license, ensuring consistency across different types of on-premises liquor licenses. It expands the list of "public interest factors" that the SLA must consider, which include the number and type of existing liquor licenses nearby, whether the applicant has secured all necessary permits, the impact on traffic and parking, noise levels, the applicant's history of liquor violations and criminal activity, and importantly, now also includes the applicant's history of building and fire code violations and any formal communications from the local municipality or community board regarding their businesses. The bill also clarifies that when considering issuing a license for a location within 500 feet of three or more existing licensed premises, the SLA must give "due consideration" to formal communications from the municipality or community board, in addition to consulting with them, before determining if granting the license is in the public interest.
