This bill, titled the Fairness in Women's Sports Act, mandates that all athletic teams and sports sponsored by public schools and public higher education institutions in Pennsylvania must be explicitly designated as male, female, or coed, with "sex" defined by immutable biological characteristics of the reproductive system determined by anatomy and genetics at birth. It prohibits athletic teams designated for females from being open to students of the male sex, while allowing students to participate in teams designated for their sex or coed teams. The bill also protects these institutions from adverse actions by government entities or athletic organizations for maintaining separate sports for females and creates legal avenues for students who are deprived of athletic opportunities or suffer harm due to violations of these provisions, as well as for retaliation against those who report violations, and for institutions harmed by external entities that interfere with their ability to enforce these designations.
