AI Summary

This bill requires electric and natural gas utilities to use a competitive bidding process, referred to as a "competitive procurement process," for contracts related to construction, operations, maintenance, or capital improvements, and the Public Service Commission (PSC), the state agency that regulates utilities, will not allow utilities to recover costs for contracts not procured this way. A bidder or customer can sue to enforce this requirement, and if successful, can recover damages and attorney fees, with bids and related documents being considered public records accessible under rules similar to the Freedom of Information Act. The bill defines "competitive procurement process" as one that aligns with federal guidelines for local governments, specifically referencing sections 2 CFR 200.319, 200.320, and 200.326, which outline standards for fair and open bidding.
