This bill establishes a "line of duty disability presumption" for certain deputy sheriff members of a retirement system in cities with a population of one million or more, meaning that if they develop a lung disease that causes total or partial disability or death, it will be presumed to have occurred in the line of duty unless proven otherwise, provided they passed a physical exam upon hiring that didn't show signs of the condition. This presumption also applies to retired members of such departments who retired within the last five years and held a deputy sheriff title. Furthermore, deputy sheriffs retiring under this provision will receive a pension equal to three-fourths of their final average salary, and those retired for five years or less who would have qualified under this new law will have their pensions recalculated to reflect this benefit.
