This bill, titled the "Hazardous Products Act," aims to prohibit the manufacture and sale of certain household products containing intentionally added PFAS, which are defined as perfluoroalkyl or polyfluoroalkyl substances that a manufacturer intentionally includes for a functional or technical effect. Starting January 1, 2027, this prohibition will apply to a wide range of products including apparel, carpets, cleaning products, cookware, cosmetics, dental floss, fabric treatments, juvenile products, menstruation products, textile furnishings, ski wax, and upholstered furniture. A manufacturer is defined as a person who makes a product or whose brand name is on it, including importers or first distributors. Violators of this act face escalating penalties, starting with a misdemeanor for a first offense and progressing to a felony for subsequent offenses, with potential jail time and fines. The bill also allows individuals to bring legal actions to stop the sale of violating products, recover damages (at least $500 plus attorney fees, or actual damages in class actions), and seek other equitable relief, with a statute of limitations of six years.
